The terms on which you may use this website. Our advertising platform is governed by a separate written agreement.
This draft must be reviewed by qualified counsel before it goes live. Items marked «LIKE THIS» require a decision or a fact only GoGo CTV can supply. The contracting entity and governing law are now settled — GoGo CTV Inc., a Wyoming corporation, under Wyoming law. What remains is the registered address, the venue county, the liability cap, and the arbitration decision in section 14. It is a drafting aid, not legal advice.
These Terms of Service govern your access to and use of gogoctv.com and the content on it. By using this website you agree to them. If you do not agree, please do not use the site.
These terms do not govern the GoGo CTV advertising platform. Access to the ad server, the Ads Manager, and any other product is governed by a separate written agreement between GoGo CTV and the customer. Nothing on this website constitutes an offer to contract, a commitment to provide any service, or a variation of any existing agreement. Where these terms and a signed customer agreement conflict, the signed agreement controls.
These terms are between you and GoGo CTV Inc., a Wyoming corporation with its registered office at «REGISTERED ADDRESS», trading as GoGo CTV ("GoGo CTV", "we", "us", "our"). "You" means the person or organisation using this website.
You may view, browse, and print pages from this website for your own internal business evaluation. You may quote short extracts with attribution to GoGo CTV and a link to the source page.
You must be at least 16 years old to use this site, and if you use it on behalf of an organisation you confirm you have authority to accept these terms for that organisation.
You agree not to:
The site and its contents — text, design, graphics, logos, code, and the selection and arrangement of it all — are owned by GoGo CTV or its licensors and are protected by intellectual property law. The GoGo CTV name and logo are our trade marks. Nothing on this site grants you any licence to use them, except as expressly stated in section 3.
Third-party names and marks referred to on this site, including those of other advertising technology providers and device platforms, remain the property of their respective owners and are used for identification only. Their use does not imply any affiliation with or endorsement by those owners.
If you send us feedback, suggestions, or ideas about our products — whether through a form, by email, or in a conversation — you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use them without restriction or compensation to you. We are not obliged to keep feedback confidential.
This does not apply to information exchanged under a signed non-disclosure agreement, which is governed by that agreement, nor to personal data, which is handled as described in our Privacy Policy.
Please do not send us confidential or proprietary information through this website's forms.
Product descriptions, technical specifications, integration details, and roadmap statements on this website are provided for general information. They describe our products as they exist or are planned at the time of publication and may change without notice.
Performance figures presented on this site — including ad decision latency, fill rates, yield improvement, and request volumes — are derived from GoGo CTV's own internal measurement across client deployments. They are illustrative of results observed in those environments, they are not audited or independently verified, and they are not a prediction, warranty, or guarantee of the results you will achieve. Actual performance depends on your inventory, demand, content, geography, player and delivery configuration, and other factors outside our control.
Any service level commitment — including any availability or uptime target — is only binding if it appears in a signed agreement between you and GoGo CTV. Figures published on this website do not create a service level commitment.
A disclaimer helps against a claim that a figure was a binding promise. It does not protect against a claim that a published figure was false or unsubstantiated when made.
One item still needs resolving on the marketing pages themselves: the stated SOC 2 attestation. Confirm the exact report type and period, and word the claim to match it, before this page is published.
Two related items are closed. The named client references on the homepage are confirmed by the operator as real, approved references. The uptime figure is no longer labelled as a contractual SLA anywhere on the site — the homepage and product page both describe it as internally measured, which is consistent with the clause above.
This website links to services we do not control, including our Ads Manager login at a separate subdomain and third-party websites. We are not responsible for their content, availability, or practices, and a link is not an endorsement. Your use of a third-party service is governed by that party's own terms.
Our handling of personal data collected through this website is described in our Privacy Policy, which forms part of these terms.
The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, GoGo CTV disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the site or the servers that make it available are free of harmful components. We do not warrant that the content is accurate, complete, or current.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
To the fullest extent permitted by law, GoGo CTV and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings, arising out of or in connection with your use of this website, whether based in contract, tort, negligence, strict liability, or otherwise, and whether or not we were advised of the possibility.
Our total aggregate liability arising out of or relating to this website and these terms will not exceed «CAP — e.g. USD 100».
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
The liability cap for a free informational website is conventionally nominal. Counsel should set the figure and confirm the carve-outs are correct for the chosen governing law, and whether consumer protection rules in any target market restrict these clauses.
You agree to indemnify and hold harmless GoGo CTV and its officers, employees, and agents against any claim, liability, loss, and reasonable expense (including legal fees) arising from your breach of these terms or your unlawful use of this website.
We may change, suspend, or discontinue any part of this website at any time without notice. We may also revise these terms; the effective date at the top of this page shows when the current version took effect, and your continued use after a change means you accept the revised terms. If a change is material we will take reasonable steps to highlight it.
These terms and any dispute arising out of them or your use of this website are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You and GoGo CTV submit to the exclusive jurisdiction of the state and federal courts located in «COUNTY», Wyoming.
«DECISION: include an arbitration clause and class-action waiver, or rely on court jurisdiction? Counsel to advise.»
If you access this website from outside the United States, you do so on your own initiative and are responsible for compliance with your local law. Nothing in this section deprives a consumer of the protection of mandatory rules of the law of their country of residence, where those rules apply.
